The lawyer of an Indian national who is facing a court in Delhi has claimed that his client has a good case in merits to stop his extradition to Australia.
Outside Delhi's Patiala House court, that they will file an appeal in case court orders his return to Australia.
"We will certainly appeal, although fingers crossed we get relief from this court,” said Mr Singhal.
Singhal said that his client is ill and is afraid of racial vilification in case he returned to Australia.
He also made a comment that there was not a proper extradition arrangement in place at the time of the incident, in 2008.
During an earlier hearing, Puneet Puneet said that he was innocent and he would fight the extradition till his death.
“I am innocent, I am being framed, the Australian authorities are trying to extradite me based on my confession before Australian police,” he was quoted saying.
Police said that Puneet was driving a car which crashed into two pedestrians, killing one and badly injuring another while driving at 148km/h in Melbourne’s Southbank in 2008.
Puneet is alleged to have fled to India using the passport of a friend in February 2009 while he awaited sentencing in the hit-and-run case.
He remained in hiding in India before he was arrested by the Punjab police in Patiala district in 2013.
The case is due back in court in August 2017.
